General Terms and Conditions
NOTICE: The units for sale by King RV/ Commonwealth Boat Brokers are normally not owned by King RV/ Commonwealth Boat Brokers, but are merely on consignment from individual sellers, which are usually banks who are selling the units as repossessed/foreclosed units. The individual seller of each unit has sole discretion as to final price and terms of sale. King RV/ Commonwealth Boat Brokers have no authority or discretion to negotiate or establish price or terms of sale of any unit. NO AGREEMENT FOR PURCHASE AND SALE OF ANY UNIT IS BINDING UNTIL IT IS IN WRITING, SIGNED BY THE INDIVIDUAL SELLER AND PURCHASER.
1. Inspect the unit. While King RV/ Commonwealth Boat Brokers will undertake reasonable efforts to accurately and fairly describe every unit on this website, King RV/ Commonwealth Boat Brokers recommends that you carefully inspect, at its premises, the unit(s) you are interested in before submitting a proposal to purchase. King RV/ Commonwealth Boat Brokers’ description of the unit is not, and shall not be construed as, any type of warranty or representation, whether express, implied or otherwise, with regard to that unit. KING RV/ COMMONWEALTH BOAT BROKERS MAKES NO WARRANTIES OR REPRESENTATIONS, WHETHER EXPRESS, IMPLIED OR OTHERWISE, WITH RESPECT TO ANY UNIT.
Before traveling to King RV/ Commonwealth Boat Brokers to inspect a particular unit, King RV/ Commonwealth Boat Brokers recommends that you call its office to confirm that the unit is still available for sale. However, due to the high volume of sales, King RV/ Commonwealth Boat Brokers cannot not be held responsible if the unit is not available when you arrive, regardless of whether the unit was available at the time of your call.
2. Make an offer. Complete the offer form. Before you click on
“submit form”, carefully review your offer to ensure that the information you
have provided is complete and accurate. King RV/ Commonwealth Boat Brokers
will promptly present your offer to the seller of the unit for consideration.
If the seller does not accept your offer, the seller may submit a counteroffer for your consideration. Upon your receipt of the seller’s counteroffer, you may accept or reject the seller’s counteroffer. If you reject the seller’s counteroffer, you are free to make another offer on the same unit. NO AGREEMENT FOR PURCHASE AND SALE OF ANY UNIT IS BINDING UNTIL IT IS IN WRITING, SIGNED BY THE INDIVIDUAL SELLER AND PURCHASER.
If the seller accepts your offer, King RV/ Commonwealth Boat Brokers will
notify you of seller’s acceptance of your offer. The bidder must make prompt
arrangements to complete a full inspection of the unit, at your sole expense
and discretion, and notify King RV/ Commonwealth Boat Brokers whether you will
purchase the unit. All inspections are to be performed at King RV/
Commonwealth Boat Brokers. NO AGREEMENT FOR PURCHASE AND SALE OF ANY UNIT IS
BINDING UNTIL IT IS IN WRITING, SIGNED BY THE INDIVIDUAL SELLER AND
PURCHASER.
If the unit is a motorhome, you have the right to a reasonable test drive of the unit as part of the inspection, provided that you present a valid driver’s license and proof of adequate insurance to cover the test drive of the motorhome.
For all other units, the inspection must be completed at the King RV/ Commonwealth Boat Brokers premises. Sorry, King RV/ Commonwealth Boat Brokers does not allow sea trials on boats.
3. Make a deposit. If you choose, and subject to approval by King RV/
Commonwealth Boat Brokers and/or the seller, you may place a deposit towards
the purchase of the unit. Due to the nature of the products that King RV/
Commonwealth Boat Brokers is advertising for sale, deposits will be accepted
on a case by case basis at the sole discretion of King RV/ Commonwealth Boat
Brokers and/or the seller. In any event, King RV/ Commonwealth Boat Brokers
will not “hold” or withdraw any unit from availability to other customers
unless an adequate deposit, acceptable to King RV/ Commonwealth Boat Brokers
and the seller, has been made and special arrangements have been made in
written form with King RV/ Commonwealth Boat Brokers. For the deposit

Deposit conditions.
4. Financing. King RV/ Commonwealth Boat Brokers offers financing to
qualified buyers on most units. Please call the King RV/ Commonwealth Boat
Brokers office to discuss the details of available financing options. Other
acceptable forms of payment for the purchase of units include cashiers check,
certified check, cash and wire transfers. Sorry, King RV/ Commonwealth Boat
Brokers does not accept personal checks or credit cards. You do not take title
or possession of the unit until payment in full is received by and fully
credited to the account of King RV/ Commonwealth Boat Brokers and/or the
seller.
5. Title. Title will not be transferred at the time of sale. Upon
receipt of payment in full and the credit of such proceeds to the account of
King RV/ Commonwealth Boat Brokers and/or the seller, King RV/ Commonwealth
Boat Brokers will give you possession of the unit, a bill of sale proving your
ownership, and appropriate temporary transport tags so that you may legally
transport the unit from the premises. On rare occasions, it may take up to
thirty (30) days from the date of purchase before you receive the title.
However, in most cases, you will receive title to the unit with fourteen (14)
to twenty-one (21) days. A title processing fee of $100.00 will be added to the
purchase price of the unit. All other registrations, licenses, personal
property taxes, etc. shall be the sole responsibility of the purchaser.
6. No Warranty or Representation. ALL UNITS ARE SOLD IN THEIR “AS IS”
AND “WHERE IS” CONDITION WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND,
WHETHER EXPRESS, IMPLIED OR OTHERWISE, INCLUDING WITHOUT LIMITATION, WARRANTY
OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALL SALES ARE FINAL.
KING RV/ COMMONWEALTH BOAT BROKERS AND/OR SELLER MAKE NO WARRANTIES OR
REPRESENTATIONS, WHETHER EXPRESS, IMPLIED OR OTHERWISE, WITH RESPECT TO ANY
UNIT. YOU ASSUME FULL RESPONSIBILITY FOR ENSURING THE PURCHASED UNIT IS
ACCEPTABLE, ROADWORTHY, AND/OR SEAWORTHY.
7. After
Sale.
All units must be removed from the King RV/ Commonwealth Boat Brokers premises
with seven (7) days following receipt by King RV/ Commonwealth Boat Brokers of
the full purchase price. You are responsible for all obligations, liabilities,
costs and expenses involved with the removal and transportation of the unit
from the King RV/ Commonwealth Boat Brokers premises. Once payment has been
received by King RV/ Commonwealth Boat Brokers, you have the sole obligation
and responsibility to properly insure the unit. Neither King RV/ Commonwealth
Boat Brokers nor the seller is responsible in any way for the unit once
payment in full has been received.
